A. Session Fees

Going forward references to a full session fee will be $285, a mini-session fee is $150, a full dance session is $325, a dream package session fee is $285, an in-studio headshot full headshot fee is $175, a full on location headshot fee is $250, a single-look in-studio headshot fee is $80, a single-look on location headshot fee is $200, a retainer fee is $100, and references to a peak season fee is $25.

Client agrees to pay photographer a retainer fee at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your full session which is a 45-50 minute session, (full dance sessions are 60-75 minutes). A balance of the full session fee is due at the time of the session. The full session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a minimum of 12 images to be downloaded by client from https://www.kenjihorvathcreativity.com/ or other means pre-arranged between the client and the photographer. Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images may be available for purchase. There is a $0 surcharge for all weekend sessions. Mini-sessions are 20 minute sessions and the client agrees to pay the photographer the mini-session fee. There is a non-refundable retainer fee that goes toward your 20 minute session. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a minimum of 6 images to be downloaded by client from https://www.kenjihorvathcreativity.com/ or other means pre-arranged between the client and the photographer. For headshot sessions the client agrees to pay the photographer the full in-studio headshot fee for a full 30 minute in studio headshot session. The full on location headshot fees will include traveling to the client within a designated radius covered by Section B. There is a non-refundable retainer fee that goes toward your 30 minute session. The full in-studio and full on location headshot fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a minimum of 6 images to be downloaded by client from https://www.kenjihorvathcreativity.com/ or other means pre-arranged between the client and the photographer. For Single-Look Headshot Sessions the client agrees to pay the photographer the single-look in-studio headshot fee for a 10-15 minute in studio headshot session (Single-Look on location Headshot sessions price is above). The full amount for the session is due at the time of booking the Single-Look Headshot unless otherwise indicated. The single-look in-studio headshot fee or single-look on location headshot fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a single image to be downloaded by client from https://www.kenjihorvathcreativity.com/ or other means pre-arranged between the client and the photographer. For Dream Package Sessions the client agrees to pay photographer the dream package session fee (if bundled with a full portrait session the dream package is $150). The non-refundable retainer fee goes toward your session fee. The dream package session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and a minimum of 3 images to be downloaded by client from https://www.kenjihorvathcreativity.com/ or other means pre-arranged between the client and the photographer. Any session scheduled for a date during peak season, which is October 1st - December 31st, will be subject to the peak season fee.

B. Location Costs and Fees

If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Unless you, the client, chooses to purchase a specific photography permit for a location, we will operate in areas that allow general photography but will be required to share those spaces with the public and also other photographers having their sessions. Even in locations where the photographer has obtained a general photography permit to operate, it does not guarantee that the photography session will be uninterrupted by other photographers trying to share the same location. In such cases either there will be a pause in the session while the other photographer is working or we will temporarily move to another area of the location to continue our session. Creative fee covers travel within 15 miles of photographer's home in Ellicott City, MD. Any location outside of these limits will be subject to a base $25 travel fee plus an additional charge of $1/mile for any distance beyond the 15 miles of the photographers home in Ellicott City, MD (this includes round trip) as part of the agreement.

C. Rescheduling

If an illness or situation prevents a photo session from taking place, the client may reschedule their session at least 24 hours prior to their shoot without penalty. Should the client fail to give 24 hours notice, or decide to completely cancel the shoot, the retainer fee is forfeited and will not be refunded. The photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

D. Re-shoots / Refunds

Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, client chosen location, mood or behavior of subjects in the photographs, or by not following the recommendations of the photographer. The retainer fee for the session is not refundable. All session fees are not refundable once the images have been delivered (Links for downloads sent to the customer). Print fees are not refundable once proof has been approved and prints ordered.

E. Archive of Session Images

After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional and other designated purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. The delivered session images will be available for download for a minimum of six (6) months after delivery to the client and will be removed at the photographer’s sole discretion at any point after the six (6) month window following the delivery of the session images. The client assumes all responsibility for download and retention of images after the aforementioned six (6) month window even if the client fails to initiate the download of their images during the timeframe.

F. Payment

All payments are due in full unless payment arrangements have been made. Images will not be processed and/or prints will not be ordered until payment in full is received.

G. Damage

Photographer is not responsible for the damage of portraits or discs after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.

I. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

J. Copyright and Penalty

Kenji Horvath Creativity retains all copyrights to all images and video created during the client’s session. A print release is included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Kenji Horvath Creativity during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If the client steals images via any method listed above, or any other method, the client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. Digital images and prints purchased from photographers can only be used for personal use and not for commercial, political, or any for-profit uses. A separate commercial release can be purchased if the images need to be used for anything other than personal use. Sharing on personal social media pages, web pages, or blogs is allowable but credit and link back to www.kenjihorvathcreativity.com is required.

H. Model Release

I hereby give to Kenji Horvath Creativity the absolute and irrevocable right and permission with respect to the photographs and any video captured that he/she has taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising (including on social media such as Facebook, Instagram, youTube, etc) and trade, and; I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
